Employing in Mexico
Mexican employment law and employment rights are contained under the Constitution of the United Mexican States (Constitución Política de los Estados Unidos Mexicanos) as well as Federal Labour Law. The employment rights provided in these can apply to anyone providing subordinated services. Employment rights in Mexico are also inalienable, meaning that they apply to everyone deemed to carry out suborindated work in Mexico, regardless of the jurisdiction chosen in employment agreements.
Federal Labour Law and Mexican labour courts are very employee-protective and favours the employee. As such, Mexican employment law provides strong labour conditions and protections for employees, so employing people will generally be an important investment and commitment.
Temporary agencies are popular options for more flexible workforce arrangements. For these and many other reasons, the following are only guidelines in the broadest sense, and professional legal services are recommended when employing in Mexico.
The minimum wage in Mexico is MXN 278.80 per day or MXN 8,364.00 per month, which equals MXN 100,368.00 per year, based on a standard 40-hour workweek. This rate is effective starting January 1, 2025.
For customers of Remote, all employee payments will be made in semi-monthly instalments by the 15th and 30th of each month.

The minimum onboarding time begins after the employee submits all required information onto the Remote platform. The onboarding timeline is also dependent upon registration with local authorities.
For all non-nationals of the country of employment, the Right to Work assessment (if applicable) will add three extra days to the total time to onboard. There may be extra time required if we need to follow-up on the right to work assessment.
Please note, payroll cut-off dates can impact the actual first day of employment. Remote has a payroll cut-off date of the 10th of the month unless otherwise specified.

The timeline for onboarding foreign national employees on this waitlist will depend on a number of factors, including offboardings, terminations, and new Remote hires of Mexican nationals.Remote is always able to onboard Mexican nationals who meet standard employment requirements. In 2024, Remote adopted the new telework legislation. This law, which sets health and safety standards for teleworking, aims to prevent accidents and illnesses and promote a safe and healthy remote work environment.
In response to Mexico's new telework laws, Remote is implementing several measures. These include a partnership with a prevention health service, and support for remote workers' electricity and internet costs. Additional support must be provided to support the worker’s activities, which include a laptop and ergonomic chair.
